Excerpt: “…March 23, 2010, Governor Lingle sent a letter to United States Senators expressing her strong opposition to H.R. 2314, the most recent version of the Akaka Bill, which passed in the House of Representatives in February. The House-passed bill reflected the outcome of negotiations among the Obama administration, the Hawaii congressional delegation, and the attorney general of Hawaii, in which some of the amendments proposed by the state were accepted, while other state-proposed amendments were not. Now the bill is in the Senate.

The governor’s recent letter describes additional amendments proposed by the state to limit the sovereign immunity of the Native Hawaiian Governing Entity that would be organized after the passage of the bill. …” Professor Wilkinson examines the positions of Governor Lingle and Native Hawaiians, and offers suggestions to achieve common ground for passage.
